PARA: KRZI, LLC y sus subsidiarias, afiliadas y empresas relacionadas, incluyendo, pero no limitándose a, Chubit Travel y Chubit Travel Colombia, así como sus respectivos directores, funcionarios, empleados, subcontratistas, proveedores, agentes, guías, voluntarios, contratistas independientes, representantes, propietarios, aseguradores, sucesores y cesionarios (individual y colectivamente, "CHUBIT TRAVEL")

EN RESUMEN:
Estoy proporcionando esta Renuncia a las empresas y personas involucradas en la organización y prestación de los servicios que he solicitado en relación con mis arreglos de viaje.

"Actividades" se refiere a las actividades y servicios que Chubit Travel proporcionará, organizará o coordinará en mi nombre, según mi itinerario elegido.

Estas pueden incluir:
participación en un recorrido de aventura
descenso de cañones
espeleología
ciclismo
vuelo en ala delta
equitación y otras actividades ecuestres
paseos en globo aerostático
ciclismo de montaña
parasailing
escalada en roca/cuerda
rappel
tirolesa
buceo
actividades en helicóptero
rafting en aguas bravas
viajes en lanchas rápidas/barcos rápidos
navegación a vela
trekking
montañismo
surf
parapente
viajes en transporte público y privado (incluyendo hacia y desde las áreas de recorrido)

RECONOCIMIENTO: SALUD Y SEGURIDAD
Soy consciente de que el esfuerzo físico requerido para participar en las Actividades puede activar o agravar lesiones preexistentes, condiciones o defectos congénitos.

Reconozco que debería buscar consejo médico si sé o sospecho que mi condición física puede ser incompatible con las Actividades.

Reconozco que se me exige usar equipo de seguridad aprobado mientras participo en ciertas Actividades. Soy consciente de que hay guías e instructores disponibles para responder cualquier pregunta que pueda tener sobre el uso adecuado de cualquier equipo.

EN RESUMEN:
Entiendo que las Actividades pueden requerir esfuerzo físico y es mi responsabilidad asegurarme de estar lo suficientemente saludable para participar. Usaré el equipo de seguridad recomendado y haré preguntas si tengo dudas sobre cómo usar el equipo de manera adecuada o segura.

ASUNCIÓN DE RIESGOS
Soy consciente de que las Actividades conllevan muchos riesgos, peligros y amenazas, que pueden incluir, entre otros:
lesiones personales y/o muerte;
viajar a áreas remotas sin acceso a instalaciones médicas o tratamiento;
condiciones climáticas cambiantes;
interacciones o encuentros con vida silvestre;
mal funcionamiento de equipos;
negligencia de otros participantes o guías;
negligencia por parte de Chubit Travel, incluyendo
la falta de salvaguardia o protección frente a los riesgos o peligros de las Actividades;
consumo de alcohol;
colisiones con vehículos, equipos o estructuras;
extraviarse o separarse de guías u otros participantes;
y la falta de permanencia dentro de áreas designadas.

EN RESUMEN:
Reconozco que existen numerosos riesgos que puedo enfrentar durante mi participación en las Actividades, incluidos los riesgos enumerados aquí.

ALCOHOL Y SUSTANCIAS ILEGALES
Si consumo o estoy bajo la influencia de alcohol o drogas ilegales antes o durante la participación en las Actividades, ACEPTO Y ASUMO TODOS LOS RIESGOS, PELIGROS Y AMENAZAS QUE PUEDAN RESULTAR DE ELLO, INCLUYENDO LA POSIBILIDAD DE LESIONES PERSONALES, MUERTE, DAÑOS A LA PROPIEDAD Y PÉRDIDAS, incluso en caso de negligencia o culpa de Chubit Travel o terceros, e indemnizaré a Chubit Travel de cualquier responsabilidad por daños a la propiedad o lesiones personales a cualquier tercero, resultantes de mi participación en las Actividades mientras, durante o después del consumo de drogas ilegales o alcohol.

EN RESUMEN:
Si consumo alcohol o drogas ilegales antes o durante mi participación en las Actividades, soy responsable de cualquier pérdida, lesión o daño que cause a mí mismo o a otros.

SOY CONSCIENTE DE LOS RIESGOS, PELIGROS Y AMENAZAS ASOCIADOS CON LAS ACTIVIDADES.
No confío en ninguna representación oral o escrita hecha por Chubit Travel sobre la seguridad de las Actividades, aparte de lo que se establece en esta Renuncia.

Acepto libremente y asumo completamente estos riesgos y la posibilidad de lesiones y pérdidas resultantes de mi participación en las Actividades.

EN RESUMEN:
Entiendo y acepto los riesgos de participar en las Actividades. Confío en las declaraciones sobre el riesgo contenidas en esta Renuncia como fuente definitiva de información sobre la seguridad de las Actividades por encima de cualquier otra comunicación o material.

SOY CONSCIENTE DE QUE SE REQUIERE UN SEGURO DE VIAJE PARA PARTICIPAR EN ESTE RECORRIDO.

Sé que Chubit Travel exige que todos los viajeros tengan un seguro de viaje suficiente para cubrir cualquier gasto médico, hospitalización, evacuación, emergencias y/o muerte durante este recorrido. Al firmar este acuerdo, certifico que tengo un seguro de viaje que me cubrirá cualquier gasto y eximo a Chubit Travel de toda responsabilidad.

Acepto libremente y asumo completamente estos riesgos y la posibilidad de pérdida monetaria y pérdida de vida resultante de la falta de cobertura de seguro de viaje.

EN RESUMEN:
Entiendo y acepto los riesgos de participar en el recorrido. Confío en las declaraciones sobre el seguro de viaje en esta Renuncia como fuente definitiva de información sobre los peligros del viaje y entiendo que Chubit Travel no será responsable de ninguna lesión, accidente, pérdida de extremidades y/o muerte durante el recorrido.

RENUNCIA DE RESPONSABILIDAD, EXONERACIÓN DE RECLAMOS Y ACUERDO DE INDEMNIZACIÓN

Como contraprestación por permitirme participar en las Actividades, acepto:

En caso de que yo, o mis herederos, suframos alguna pérdida, daño, gasto o lesión como resultado de mi participación en las Actividades, INCLUYENDO AQUELLOS CAUSADOS POR LOS RIESGOS ESPECÍFICAMENTE INDICADOS EN ESTA RENUNCIA, ACEPTO RENUNCIAR A CUALQUIER Y TODOS LOS RECLAMOS que pueda tener ahora o en el futuro contra CHUBIT TRAVEL y LIBERO A CHUBIT TRAVEL de toda responsabilidad;
QUE MANTENDRÉ INDEMNE Y LIBRE DE RESPONSABILIDAD A CHUBIT TRAVEL por cualquier daño a la propiedad o lesión personal a cualquier tercero como resultado de mi participación en las Actividades;
Cualquier litigio entre las partes de este Acuerdo se llevará exclusivamente en la ciudad de Medellín, Colombia y estará sujeto a la jurisdicción exclusiva de los tribunales de Medellín, Colombia.
Este Acuerdo será efectivo y vinculante para mis herederos, sucesores, albaceas, administradores, cesionarios y representantes en caso de mi fallecimiento o incapacidad.
Este Acuerdo y cualquier derecho, deber u obligación entre las partes de este acuerdo se regirán e interpretarán únicamente de acuerdo con las leyes de Medellín, Colombia y ninguna otra jurisdicción.

HE LEÍDO Y COMPRENDO ESTE ACUERDO ANTES DE MARCAR LA CASILLA DE CONFIRMACIÓN DE MI ACEPTACIÓN.

Soy consciente de que al marcar la casilla a continuación, estoy renunciando a ciertos derechos legales que pueda tener contra Chubit Travel.

PARA PARTICIPANTES MENORES DE EDAD: Por la presente, certifico que, como padre/tutor legalmente responsable de este participante menor de edad, consiento y acepto su liberación de toda responsabilidad por parte de CHUBIT TRAVEL, y en mi nombre, mis herederos, cesionarios y siguientes de kin, libero y acepto indemnizar a CHUBIT TRAVEL por cualquier responsabilidad relacionada con la participación de este participante menor de edad en las Actividades.

ENGLISH:
BY AGREEING TO THE TERMS OF THIS AGREEMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS.

PLEASE READ CAREFULLY

TO: KRZI, LLC, and its subsidiaries, affiliates and related companies including, but not limited to, Chubit Travel and Chubit Travel Colombia, and their respective directors, officers, employees, subcontractors, suppliers, agents, guides, volunteers, independent contractors, representatives, owners, insurers, successors and assigns (individually and collectively, "CHUBIT TRAVEL)

SIMPLY PUT:
I am providing this Waiver to the companies and people involved in organizing and providing the services I have requested in connection with my travel arrangements.

"Activities" means the activities and services that Chubit Travel will be providing, arranging or organizing on my behalf depending on my chosen itinerary.

These may include:
participation in an adventure travel tour
canyoneering
caving
cycling
hang-gliding
horse riding and other equine activities
hot air balloon rides
mountain biking
parasailing
rock/rope climbing
rappelling
zip lining
scuba diving
helicopter activities
white water rafting
travel in jet boats/speed boats
sailing
trekking
mountaineering
surfing
paragliding
travel in public and private transportation (including to and from tour areas)


ACKNOWLEDGMENT – HEALTH & SAFETY
I am aware that the physical exertion required to participate in the Activities can activate or aggravate pre-existing injuries, conditions, or congenital defects.

I acknowledge that I should seek medical advice if I know or suspect that my physical condition may be incompatible with the Activities.

I acknowledge that I am required to wear approved safety equipment while participating in certain Activities. I am aware that there are guides and instructors available to answer any questions I may have as to the proper use of any equipment.

SIMPLY PUT:
I understand that the Activities may require physical exertion and it is my responsibility to make sure I am healthy enough to participate. I will use the recommended safety equipment and ask questions if I am unsure about how to properly or safely use equipment.

ASSUMPTION OF RISKS
I am aware that the Activities involve many risks, dangers and hazards which may include but are not limited to:
personal injury and/or death;
travel to remote areas without access to medical facilities or treatment
changing weather conditions;
interactions or encounters with wildlife;
equipment malfunctions
negligence of other participants or guides;
negligence on the part of the Chubit Travel, including
failure to safeguard or protect from the risks or dangers of the Activities
consumption of alcohol;
collisions with vehicles, equipment or structures;
becoming lost or separated from guides or other participants;
and the failure to remain within designated areas.


SIMPLY PUT:
I acknowledge that there are numerous risks I may face during my involvement in the Activities including the risks listed here.

ALCOHOL AND ILLEGAL SUBSTANCES
If I use, consume or am under the influence of alcohol or illegal drugs prior to or while engaging in the Activities, I ASSUME AND ACCEPT ALL RISKS, DANGERS AND HAZARDS THAT MAY RESULT FROM THIS INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS , even in the event of negligence or fault by Chubit Travel or third parties, and will indemnify Chubit Travel from any and all liability for any damage to property or personal injury to any third party, resulting from my participation in the Activities, while, during or after consumption of illegal drugs or alcohol.

SIMPLY PUT:
If I consume alcohol or illegal drugs before or during my involvement in the Activities I am responsible for any loss, injury or damage I cause to myself or others.

I AM AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE ACTIVITIES.
I am not relying on any oral or written representations or statements made by Chubit Travel about the safety of the Activities other than what is stated in this Waiver.

I freely accept and fully assume these risks and the possibility of injury and loss resulting from my participation in the Activities.

SIMPLY PUT:
I understand and accept the risks of participating in the Activities. I am relying on the statements about the risk contained in this Wavier as the definitive source of information about the safety of the Activities over any other communications or materials.

I AM AWARE TRAVEL INSURANCE IS REQUIRED TO PARTICIPATE ON THIS TOUR.

I am aware Chubit Travel requires all travelers to have sufficient travel insurance to cover any medical expenses, hospitalization, evacuation, emergencies and/or death during this tour. By signing this agreement I attest I have Travel Insurance that will cover me for any expenses and relieve Chubit Travel from all liability.

I freely accept and fully assume these risks and the possibility of monetary loss and loss of life resulting from the lack of travel insurance coverage.

SIMPLY PUT:
I understand and accept the risks of participating on the tour. I am relying on the statements about travel insurance in this Wavier as the definitive source of information about the dangers of travel and understand Chubit Travel will not be responsible for any injury, accidents, loss of limbs and/or death while on tour.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of Chubit Travel allowing me to participate in the Activities I agree:

In the event that I, or my next of kin, suffer any loss, damage, expense or injury from my participation in the Activities, INCLUDING THOSE CAUSED BY THE RISKS SPECIFICALLY OUTLINED IN THIS WAIVER, I AGREE TO WAIVER ANY AND ALL CLAIMS I have or may have in the future against CHUBIT TRAVEL and to RELEASE CHUBIT TRAVEL from any and all liability;
TO HOLD HARMLESS AND INDEMNIFY CHUBIT TRAVEL from any and all liability for damage to property or personal injury to any third party resulting from my participation in the Activities;
Any litigation involving the parties to this Agreement shall be brought solely within the city of Medellin, Colombia and shall be within the exclusive jurisdiction of the Courts of Medellin Colombia
This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives in the event of my death or incapacity.
This Agreement and any rights, duties, and obligations as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of Medellin, Colombia and no other jurisdiction

I HAVE READ AND UNDERSTAND THIS AGREEMENT PRIOR TO CHECKING THE BOX BELOW CONFIRMING MY AGREEMENT.

I am aware that by checking the box below I am waiving certain legal rights which I may have against Chubit Travel.

FOR PARTICIPANTS OF MINORITY AGE: I hereby certify that I, parent/guardian with legal responsibility for this participant of minority age, do consent and agree to his/her release of all CHUBIT TRAVEL, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnify CHUBIT TRAVEL for any and all liabilities incident to this participant of minority age's participation in the Activities.
